1. OBJECT AND SCOPE

These terms and conditions govern the use of the SolveLens service (hereinafter, "the Service") offered by SolveLens. By subscribing to the Service, the user accepts these terms and conditions in their entirety.

2. SERVICE DESCRIPTION

SolveLens is a monthly web maintenance, monitoring and management service that includes:

• Automatic daily backups or according to the contracted plan
• Website status monitoring (Pro Plan only)
• Support for small content, image or text changes
• Access to a control panel to check service status
• Security updates and system maintenance
• Alerts and notifications in case of incidents (Pro Plan only)

The Service does NOT include:
• Development of significant new features
• Graphic or creative design
• Major structural improvements
• Extensive content management or new content creation

3. SUBSCRIPTION AND PRICING

3.1. Available Plans

The Service is subscribed to on a monthly basis with two plans available:

• Basic Plan: €19/month (VAT included)
- Maintenance and updates
- Automatic backups
- Support for small changes
- Basic control panel

• Pro Plan: €39/month (VAT included)
- All Basic Plan features
- 24/7 monitoring
- Alerts and priority response
- Detailed history and statistics

3.2. Billing

Payment is made monthly by credit or debit card through Stripe. The first invoice is generated at the time of subscription and subsequent ones each month on the same date.

3.3. Price Modification

SolveLens reserves the right to modify prices with 30 days' prior notice. If you do not accept the modification, you may cancel your subscription before it takes effect.

4. USER OBLIGATIONS

The user agrees to:

4.1. Truthful Information
• Provide truthful, accurate and up-to-date information
• Keep contact details updated
• Communicate any relevant changes in their situation

4.2. Credentials and Access
• Maintain the confidentiality of their access credentials
• Provide necessary access (hosting, FTP, WordPress, databases, DNS) for service delivery
• Ensure that SolveLens has the necessary permissions to perform maintenance tasks
• Notify immediately any changes in the provided access

4.3. Use of Service
• Use the Service only for legal and legitimate purposes
• Not use the Service for illegal, fraudulent or system-vulnerating activities
• Respect third-party intellectual property rights
• Not interfere with the operation of the Service

4.4. Collaboration
• Respond in reasonable time to requests for information or clarification
• Facilitate communication necessary for service delivery
• Notify in advance of important changes that may affect the service

5. SOLVELENS OBLIGATIONS

SolveLens agrees to:

5.1. Service Delivery
• Provide the Service with appropriate professional diligence
• Maintain confidentiality of all user data and credentials
• Perform backups according to the contracted plan
• Respond to requests within agreed timeframes
• Clearly communicate service status and any incidents

5.2. Security
• Implement adequate security measures to protect data
• Keep systems updated and apply security patches
• Perform backups regularly and reliably
• Notify the user of relevant security incidents

5.3. Availability
• Make best efforts to keep the Service available
• Inform the user of scheduled maintenance in advance
• Respond quickly to incidents (especially for Pro Plan)

6. PLAN CHANGE

6.1. Upgrade
Users can upgrade from Basic Plan to Pro Plan at any time. The change will be effective immediately and billing will be prorated.

6.2. Downgrade
Users can switch from Pro Plan to Basic Plan at any time. The change will be effective at the end of the current billing period.

7. CANCELLATION

7.1. Cancellation by User
Users may cancel their subscription at any time without commitment or penalty. Cancellation will be effective at the end of the current payment period. The user will continue to have access to the service until the end of the paid period.

7.2. Cancellation by SolveLens
SolveLens may cancel the Service in the following cases:
• Payment default after 15 days from notification
• Serious breach of these terms and conditions
• Fraudulent or illegal activity
• User preventing necessary maintenance tasks from being performed

In case of cancellation due to payment default, SolveLens reserves the right to temporarily suspend the service until payment.

7.3. Effects of Cancellation
In case of cancellation:
• Access to the control panel will be maintained for a period of 30 days to allow data download
• Backups will be retained for a period of 90 days after cancellation
• SolveLens will provide migration assistance if requested

8. LIMITATION OF LIABILITY

8.1. General Liability
SolveLens shall not be liable for:
• Indirect damages, lost profits or loss of benefits
• Damages resulting from data loss, provided it has complied with backup obligations according to the contracted plan
• Damages resulting from actions of third parties (hosting providers, external services, etc.)
• Damages resulting from user actions or lack of cooperation
• Damages resulting from force majeure

8.2. Coverage
SolveLens's total liability shall not exceed the value of fees paid in the 12 months prior to the event giving rise to the claim.

8.3. Backups
SolveLens performs regular backups according to the contracted plan, but the user is responsible for having additional copies if they consider it necessary.

9. INTELLECTUAL PROPERTY

9.1. User Content
Users retain all rights to their content, data and intellectual property. SolveLens only uses this content to provide the Service.

9.2. SolveLens Service
All intellectual property rights over the Service, control panel and tools developed by SolveLens belong to SolveLens.

10. DATA PROTECTION

The processing of personal data is governed by the Privacy Policy, which forms part of these terms and conditions.

11. MODIFICATIONS

11.1. Modification of Terms
SolveLens reserves the right to modify these terms and conditions, notifying users with at least 30 days' notice by email or through the control panel.

11.2. Acceptance
If you do not accept the modifications, you may cancel your subscription before they take effect without penalty.

11.3. Service Modification
SolveLens may modify, improve or update the Service at any time, provided it does not significantly reduce the contracted functionalities.

12. COMMUNICATIONS

12.1. Notifications
Communications between the parties will preferably be made by email to the provided addresses.

13. DISPUTE RESOLUTION

13.1. Applicable Law
These terms are governed by Spanish law.

13.2. Jurisdiction
For any dispute arising from these terms, the parties submit to the courts of the user's domicile, expressly waiving any other forum that might correspond to them.

13.3. Mediation
Before initiating any legal action, the parties commit to attempting to resolve disputes through mediation.

14. FINAL PROVISIONS

14.1. Partial Nullity
If any provision of these terms is null or ineffective, the rest of the provisions will remain in force.

14.2. Complete Agreement
These terms and conditions, together with the Privacy Policy, constitute the complete agreement between the parties regarding the Service.

14.3. Waiver
Failure to exercise any right by SolveLens does not constitute a waiver of the same.

14.4. Assignment
Users may not assign or transfer their rights or obligations without the prior written consent of SolveLens.

These terms and conditions have been accepted by the user at the time of subscription to the Service.
